This is awful.  I can't believe a school would do this and that a court would uphold it.  And the details of the case only make it even more painful:  that a student "told on them" for saying "I love you"; that a teacher spied on them and used details on MySpace to accuse them; that the school informed the girls' parents of their suspected lesbianism; that a principal dared to address a student in such a manner about their personal, private lives and bodies.

To the administrators of California Lutheran High School:  you are shameful people who have taken an unbelievable, unconscionable, digusting action.  You do not deserve to be in charge of the welfare of children. 

To the court:  I only hope your error does not have the far-reaching effects we all know it could have.

To the girls:  There are millions of people in this country who will love and honor you just as you are (lesbian, undecided, whatever).  Please know that you have our support.

There are several problems with the decision, but I'd like to focus on just a few. The decision appears to be justified by the court solely on the fact that the school involved was private. But that ignores the egregious conduct of the school itself. Where will the line be drawn? At strip searches? At low comedy movie scenes in which teachers and administrators spy on the kids taking showers? At wiretapping? At making judgment calls on the most innocent of student behaviors? In other words, the students, despite what the 4th District Appeals Court may believe, have Constitutional Rights to Privacy that have been blatantly trampled. Moving to the pragmatic, many areas have such bad public schools that the only option (at least for those who can afford it) is private school. This decision is much more far-reaching and affects far more than those who choose a Lutheran school because they believe in all things Lutheran.
